What should I do if I am contacted by the police?
You should respectfully tell the police that you would like to speak with an attorney before you talk with them. After that, contact an attorney as soon as possible. If you don’t, the consequences can be extremely serious and saying something wrong can result in a lot of trouble.
Oftentimes when an officer is making a phone call to someone about a situation, the officer already thinks this officer is probably guilty. So the questioning from the police officer is designed to make their case stronger. In certain circumstances, an officer is required to read Miranda warnings. And that’s if they’re going to interrogate you after you’ve been placed under arrest.
So just because you’re placed under arrest doesn’t necessarily mean that they have to read you your rights. It’s only if there is questioning afterwards.
