Texas Penal Code Section 21.11 provides that a person commits the offense of indecency by engaging in sexual contact with the child or causes the child to engage in sexual contact.:

• if the offense is committed with a child
  • who is younger than 17 years old; and
  • not the person's spouse.

Under the Texas statutes for the crime of indecency with a child the term "sexual contact" is defined to include the following acts “if committed with the intent to arouse or gratify the sexual desire of any person:”

• any touching by a person, including touching through clothing, of the anus, breast, or any part of the genitals of the alleged victim; or
• any touching of any part of the body of the alleged victim, including touching through clothing, with the anus, breast, or any part of the genitals of a person.”
