What do I do if I am contacted by the police?

If the police contact you about a criminal matter, it is ALWAYS in your best interests to talk to an attorney. Even if you do not think that you are directly involved, it is better to have someone experience with criminal matters speaking for you and protecting your rights.

What if I have a warrant out for my arrest?

You should contact an attorney. Then you should make arrangements to post a bond. You can either post your own bond in cash at 49 San Jacinto or pay a bail bondsman to post your bond. The bail bonding companies generally charge a percentage of the bond amount to post your bond. If you post a cash bond, you can expect to receive that money six to eight weeks after your case is finished.

When is my first court date?

If you post a bond, your court date may either be a few days or up to a week after you post a bond. Your bonding company should provide you with the court and date information when you post bond.

Do I need to go to court if I hire a lawyer?

Absolutely. Not only do you have to be in attendance at every court setting, you MUST be on time. Pay attention to the time listed on the bonding papers and be there early. You may have delays finding parking, going through security, and catching the elevators. Judges may forfeit your bond and take you into custody for being late.

What will happen when I go to court?

For the most part, you will not do much more than sit and wait while your attorney takes notes, talks with the prosecutor and determines the next best step for your case.

What role does the judge play in determining the outcome of your case?

The judge has little if any input in the investigation and negotiation process of your case. The primary decision makers are the defense attorney and the prosecutors. Generally, a judge presides over trials and enforces the rules of Civil Procedure and Evidence during trial. A judge may be requested to conduct sentencing if a Defendant is found guilty during trial. A judge will also determine whether they believe a plea bargain is too harsh or too lenient for a Defendant and may reject the plea if the judge does not agree with it.
